Gerald Orseck, of Liberty, NY (attorney for the creditor, Helen-May Holdings, LLC -Irene Griffin) was given his marching orders in no uncertain terms. He was instructed to have the bankruptcy stay lifted, thereby paving the way for an eviction, and the debtors were to be found in contempt of court for not making their court ordered payments nor "adequate protection." After advising his clients that the hearing had been adjourned, which he knew to be untrue, Orseck did himself attend such hearing and did enter into an unauthorized settlement with the debtor. Facing overwhelming evidence that Gerald Orseck, was not authorized to enter into a settlement, (including Orseck's own verbal recanting of such, with supporting affidavits, pleadings, depositions and sworn testimony) the debtor, (Congregation Kolel Mateh Efraim, a/k/a Mateh Ephraim; a/k/a Kolel Mateh Efraim, LLC tax ID #11-283963 a New York State Religious Corporation with a congregation at: 5608 13th Avenue, Brooklyn, NY) nevertheless mounted a vigorous, and contentious eighteen month convoluted campaign in an effort to cram down a settlement that had never been confirmed. The debtor also filed for several adjournments during the Unauthorized Settlement phase of their chapter 11 bankruptcy, thus delaying a decision, so that the debtor could continue to occupy Irene Griffin's property without paying for it. Obviously, this was a covertly conspired diversion that was very much to the debtor's advantage. The court did find that Orseck lied to his client, and to the court, and that the case was not settled!
